About: A Slice of the Pie

Create collaborative artworks, immediately exhibit them in a renowned art institution, sell them as NFTs, share the profits

With A Slice of the Pie, you can exhibit your art at Kunsthalle Zürich inside of a big, digital pie. Buy one or more slices online for a few Tezos cryptocoins and fill them with your artwork. It will be displayed in the exhibition space on a 16 square- metre LED wall, which is also livestreamed online. This way, you can become a participating artist in the exhibition DYOR.

You might choose to fill the whole pie or buy only a few slices. Other artists can do the same. Will you cooperate with them or try to hide their content? If your artwork is covered up, you can bring it to the front ten times, so be sure to check the livestream often! A collaborative – or competitive – artwork results from the process.

Once a day, at a random time determined by an algorithm, the pie is frozen and then minted as an NFT. Do you like the pie you see and don’t want to wait ? Then, you can pay to freeze the pie yourself.

The pie is then minted as an NFT on the Tezos blockchain and put up for sale on Objkt.com, while it is still visible on this website and in the space until the next day. The profits derived from its sale are shared among the artists who own visible slices.

Every 24 hours the whole process starts again, resulting in 100 pies created during the course of the exhibition.

A Slice of the Pie derives from the artists’ ongoing reflection on gatekeeping in the art world and the monetisation of access to it. Focussing on the crypto scene, the artwork updates these themes, which Silvio Lorusso and Sebastian Schmieg first explored in Projected Capital (2018). A Slice of the Pie allows both cooperation and competition, both consensual decision-making and winner-takes-it-all resolutions. The artwork is inspired by the dry language of financial charts and dashboards as well as the cutthroat design of ’battle royale’ games. Launching in a time of backlash towards crypto, A Slice of the Pie puts its promises of participation to the test.

FAQ

How do I get a slice?

To participate in A Slice of the Pie, you need a Tezos wallet. To create one, you can install the Temple extension for Chrome or for Firefox.

Once you have Temple installed, you need to buy Tezos. You can easily do that in the Temple interface

At this point you’re all set to get slices. Just connect your wallet and purchase one or more.

How much does it cost?

A single slice costs 1tz, but the price per slice increases with the number of slices purchased. The price for 6 slices is, thus, 21tz. This is to limit instant sales of the entire pie and to encourage collaboration among artists.

What do I do with my slices?

Once you have purchased your slices, you can fill them with your artwork. You can upload any type of image, an animated gif or a video. Use the available templates to position your content perfectly.

Is this live?

Yes! As soon as you click "Publish", your artwork will be displayed on a 16-square-meter LED wall in Kunsthalle Zürich, on this website and can be seen on the livestream. Be patient: the livestream is always a few seconds behind!

Is my artwork shown in an exhibition?

Yes, your artwork will become part of the DYOR exhibition curated by Nina Roehrs. This way, you become a participating artist in the show.

Can I change the content of my slice after having uploaded something?

Yes! You can replace the content as many times as you want.

The content of my slice is hidden. What now?

No worries! You can make your slice visible again up to 10 times. Make sure you check often, as other artists are able to do the same.

For how long is my artwork displayed?

Each pie is displayed for a maximum of 12 hours before it is minted as an NFT.

How is the pie minted?

The pie is minted as NFT at a random time, unless you or someone else pays to freeze the pie before that moment by clicking on ‘Mint now’.

What happens when the pie is minted?

Once the pie is minted, it is auctioned on Objkt.com. If your slices are visible in the minted pie, and when the pie gets sold, you receive 15% of the profits for each slice you own.

What license is used for the minted pie?

Creative Commons Attribution-ShareAlike

How many pies will be created?

100. Everyday from 7 October 2022 till 14 January 2023 a new empty pie will be ready to be filled.

Are the artworks moderated in any way?

No. But A Slice of the Pie reserves the right to remove any offensive or exclusionary content from the pie. See the Terms and Conditions for details.

Terms and Conditions

A. Introduction

"A Slice of the Pie" is an art project (the "Art Project") developed by Sebastian Schmieg and Silvio Lorusso (the "Artists") together with Kunsthalle Zürich (the "Kunsthalle", and together with the Artists, the "Operator"), an association organized under the laws of Switzerland, with a show room at Limmatstrasse 270, 8005 Zurich, Switzerland (the "Show Room"). The Art Project consists of a round circle (the "Pie") that is divided into equal six slices (each a "Slice") which is shown (i) electronically on a screen in the DYOR exhibition at the Show Room for a limited period of time as determined by the Operators (the "Exhibition") and (ii) on a website maintained by the Artists (the "Site").

The Operators' provision of the Site, the Exhibition and all other services related thereto (collectively, the "Services") are subject to the following terms and conditions (the "Terms and Conditions"). By using the Services, you (the "User", and together with the Operators, the "Parties") agree to enter into an agreement with the Operators and to be bound by the Terms and Conditions.

B. Purchase of a Slice

A User that wishes to interact with the Art Project may access the Site, connect its cryptocurrency wallet with the Site and purchase a Slice from the Operators against a consideration in Tezos. The payment of the consideration is processed by transferring the relevant Tezos from the User's cryptocurrency wallet to the Operator’s cryptocurrency wallet on the Tezos blockchain.

A User may choose to purchase any number of the six Slices. Upon such purchase, the User has the right to upload content (the "Content) to the Site that will be published on the part of the screen in the Exhibition and the Site that is designated to the Slice until the relevant Slice is purchased by another User. After the relevant Slice has been purchased by another User, the User has the right to request another ten times that its uploaded content will be shown on the relevant Slice.

At a random time each day, as determined by the Operators, or upon payment by a User of a certain amount in Tezos, the Operator may store a picture of the composition of the six Slices (the "Pie"). The Operator (or a third party appointed by it) may, at its own cost, issue a non-fungible token (the "NFT") on the Tezos blockchain that is linked to such Pie and may sell such NFTs in an auction to third parties. The conditions of such auction are determined exclusively by the Operator. In case of a completed sale of an NFT, the net proceeds resulting from such sale (minus a fee determined by the Operators and independently by the auction platform) will be distributed equally among the six Users that purchased a Slice of the Pie. Payment of such proceeds will be processed automatically on the Tezos blockchain by transferring the relevant Tezos from the auction platform to the User's cryptocurrency wallet connected with the Site.

C. Resale of NFTs

A person that purchased an NFT from the Operator (the "Initial Purchaser") may resell the NFT to other third parties at its own cost and on its own conditions. The Initial Purchaser and each further purchaser of the NFT acknowledge and agree that by every resale or other transfer of the NFT on the Tezos blockchain a commission in Tezos (the "Royalties") will apply. From the Royalties a share determined by the Operators will be transferred to Kunsthalle's and the artists (Sebastian Schmieg and Silvio Lorusso) cryptocurrency wallet. The remaining proceeds from such Royalties will be distributed equally among the six Users that purchased a Slice of the Pie. Payment of such proceeds will be processed automatically without the involvement of the Operators on the Tezos blockchain by transferring the relevant Tezos to the User's cryptocurrency wallet connected with the Site.

D. Prohibited Conduct

By using any of the Services, the User agrees not to:

  1. use the Services for any illegal purpose or in violation of any laws or regulations;
  2. violate or encourage others to violate third-party rights, including the infringement or misappropriation of intellectual property rights;
  3. upload or have published any Content that is unlawful, defamatory, libelous, objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate;
  4. circumvent, disable, fraudulently engage, or otherwise interfere with the features of the Services (including with respect to the limitation to have the Content published a maximum of ten times after a purchase of a Slice);
  5. interfere with the operation of the Service or another User's use of the Service (including by uploading or spreading viruses, adware or spyware);
  6. use the Service to distribute unsolicited promotional or commercial content or other unwanted or mass solicitations;
  7. copy or reproduce the Site or access, download, copy, modify, distribute, perform, or use any Content or the Art Project to create a similar or competitive service or to contribute the Content to an existing similar or competitive service; or
  8. attempt to do, or assist anyone else to do, any of the activities listed in this section D.

E. Representations and Warranties of the User

The User is solely responsible for the Content and any consequences that arise from or in connection with the uploading of the Content to the Site. Each time the User uploads Content on the Site, the User represents and warrants to each of the Operators that:

  1. The User is the creator and owner of the Content or the User owns all necessary rights from all relevant third-parties to use the Content for purposes of the Services.
  2. The Content uploaded by the User does not and will not infringe or misappropriate any third-party right, including copyright and other intellectual property rights, privacy rights, rights of publicity, or moral rights, or slander, defame, or libel anyone.

F. Reservation of Rights

The Operators are under no obligation to any User or a third party to monitor, edit, or control the Content uploaded on the Site and hereby exclude any responsibility or liability, to the extent permissible by applicable mandatory law, for the Content uploaded on the Site and shown in the Exhibition.

The Operators reserve the right to, at any time and without prior notice, to provide any of its Services or to remove, edit, screen or block any Content from the Site and the Exhibition for any reason, including in case of a breach of the Terms and Conditions or in case any of the Content is otherwise inappropriate. In addition, the Operators reserve the right, at any time and without prior notice, not to store a picture of the Pie or not to issue an NFT for any reason, including in case of a breach of the Terms and Conditions or in case any of the Content is otherwise objectionable.

G. Transfer of Rights related to Content

The User grants, or transfers to, the Operators all rights and licenses, including in respect of the Content, and otherwise that are required to provide the Services, including in connection with the publication of the Content on the Site and in the Exhibition, the storage of a picture of the Pie and the creation and sale of an NFT relating to such Pie.

The User understands and agrees that the Operators will not compensate the User (except as set forth in Sections B and C of these Terms and Conditions). In particular, the User understands and agrees that the Content may be distributed and made available to the public without providing for any compensation (except as set forth in Sections B and C of these Terms and Conditions).

H. Ownership of the Services

The Operators own and operate the Service. All of the software, visual interfaces, graphics, designs, information, and all other elements of the Services that the Operators provide are protected by intellectual property and other laws. The User must not use these materials except as specifically permitted under these Terms and Conditions.

I. Indemnity and Limitation of Liability

The User shall hold the Operators harmless of, and indemnify the Operators against, any losses, damages, claims, reasonable costs or reasonable expenses (including legal fees) which the Operators may suffer as result of, or arising from or based upon, any breach of (i) any of the representations made by the User in these Terms and Conditions, (ii) any covenant or agreement of the User contained in these Terms and Conditions or (iii) the User's violation of anyone’s rights, including intellectual property rights.

The Operators shall not be liable for any loss or damage suffered by the User save in respect of such loss or damage which is suffered as a result of wilful misconduct (Absicht) or gross negligence (grobe Fahrlässigkeit) of the Operators. Any liability of the Operators towards the User under these Terms and Conditions shall not be joint and several (nicht solidarisch).

J. Modification and Amendment

The Operators reserve the right to amend these Terms and Conditions at any time for any reasons. Any such amendments will be communicated to the User in an appropriate manner in advance. They are deemed to have been accepted unless the User objects in writing or any other form that constitutes proof through text within 30 days of their communication.

K. General Provisions

These Terms and Conditions constitute the entire agreement and understanding among the Parties with respect to the subject matter hereof, and supersedes all prior oral or written agreements and understandings of the Parties relating to such subject matter.

These Terms and Conditions and all or any of the rights and obligations hereunder shall not be assigned or transferred by the User without the prior written consent of the Operators.

If any part or provision of these Terms and Conditions or the application of any such part or provision to any person or circumstance shall be held to be invalid, illegal or unenforceable in any respect by any competent arbitral tribunal, court, governmental or administrative authority, (a) such invalidity, illegality or unenforceability shall not affect any other part or provision of these Terms and Conditions or the application of such part or provision to any other person or circumstances, and (b) the Parties shall endeavor to negotiate a substitute provision that best reflects the economic intentions of the Parties without being invalid, illegal or unenforceable, and shall execute all agreements and documents required for its implementation.
